On the evening of February 20, 1970, on a roadway along the Chicago & North Western Railroad tracks in Racine county, Patricia Green, aged seventeen, was bludgeoned to death by her brother-in-law Donald Ray Gibson. He was charged with first-degree murder and pleaded not guilty and not guilty by reason of insanity. He elected to be tried under the American Law Institute test of insanity and asked for a bifurcated trial. In his defense he claimed that a few hours before the slaying he had ingested two amphetamine capsules and had suffered such a pronounced reaction to the drug that at the time of the killing he was incapable of forming the specific intent to kill.
